Terms of Service

By downloading, installing or using VivaPic ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

VivaPic is owned and operated by 00LAR Solutions. We reserve the right to modify these Terms at any time. Modifications will take effect immediately upon posting in the App.

VivaPic is a mobile application that uses artificial intelligence to:

• Convert photographs into 6-second animated videos • Offer creative ideas and predefined effects • Allow users to write their own animation ideas • Generate unique AI-based visual content

The service is available in a free version with limited features and a VivaPic PRO version with premium features.

To use VivaPic, you must:

• Be at least 13 years of age • If between 13 and 18 years old, have consent from a parent or legal guardian • Not be prohibited from using the service under applicable laws • Provide accurate information when creating an account

We reserve the right to terminate accounts that do not meet these requirements.

4.1 Account Creation

You can use basic features without an account, but some features require registration. By creating an account, you agree to:

• Provide accurate and current information • Maintain the confidentiality of your credentials • Be responsible for all activity under your account • Notify us immediately of any unauthorized use

4.2 Account Security

You are responsible for maintaining the security of your account. We are not liable for losses resulting from unauthorized use of your account.

5.1 Ownership

You retain all rights to the photos you upload to VivaPic. By using the service, you grant us a limited, non-exclusive, temporary license to process your photos solely for the purpose of generating the requested videos.

5.2 Content Responsibility

You are solely responsible for the content you upload. By using VivaPic, you represent and warrant that:

• You have all necessary rights to the photos you upload • The content does not infringe third-party rights • The content is not illegal, offensive, defamatory or inappropriate • You have consent from people appearing in the photos

5.3 Prohibited Content

You may not use VivaPic to process content that:

• Is illegal or promotes illegal activities • Contains sexually explicit or pornographic material • Promotes violence, hatred or discrimination • Infringes third-party intellectual property rights • Contains personal information of third parties without their consent • Is fraudulent, deceptive or spam

6.1 Nature of AI Content

Videos generated by VivaPic are created using artificial intelligence. Due to the nature of the technology:

• Results may vary and are not precisely predictable • AI may interpret ideas differently than expected • We do not guarantee that results will meet specific expectations • Quality may be affected by the quality of the original photo

6.2 Ownership of Generated Videos

You own the videos generated from your photos. However:

• You cannot claim the content was created exclusively by you without mentioning AI use • You must comply with applicable laws regarding AI-generated content • You cannot use the videos for illegal or harmful purposes

6.3 Video Use

Generated videos may be used for:

• Personal use and entertainment • Sharing on social media • Commercial use (only with VivaPic PRO and complying with these Terms)

7.1 Description

VivaPic PRO is a premium subscription service offering:

• Unlimited videos per week • No watermarks • Premium HD quality • Exclusive ideas and effects • Early access to new features • Priority support

7.2 Price and Billing

• Price: $4.99 USD per week (or local equivalent) • Trial period: 7 free days • Billing: Through Apple App Store or Google Play Store • Renewal: Automatic at the end of each period

7.3 Cancellation

• You can cancel at any time • Cancellation must be made at least 24 hours before renewal • Cancellation is done from your App Store or Play Store settings • After canceling, you will maintain access until the end of the paid period • No refunds are granted for partial periods

7.4 Price Changes

We reserve the right to change prices. We will notify you in advance of changes affecting your current subscription.

8.1 Our Property

VivaPic, including its software, design, logos, trademarks, and all original content, is owned by 00LAR Solutions and is protected by intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms.

8.3 Restrictions

You may not:

• Copy, modify or distribute the App • Reverse engineer or decompile the software • Use the App to create competing products • Remove copyright notices or trademarks • Sublicense or transfer your license to third parties

9.1 "As Is" Service

VivaPic is provided "as is" and "as available", without warranties of any kind, express or implied.

9.2 No Warranties

We do not warrant that:

• The service will be uninterrupted or error-free • AI results will meet specific expectations • The App will be compatible with all devices • Defects will be corrected

9.3 Limitation of Damages

To the maximum extent permitted by law, 00LAR Solutions shall not be liable for:

• Indirect, incidental, special or consequential damages • Loss of data, profits or revenue • Service interruptions • AI-generated content

Our total liability shall not exceed the amount you have paid for the service in the last 12 months.

You agree to indemnify and hold harmless 00LAR Solutions, its directors, employees and affiliates from any claims, damages, losses or expenses (including legal fees) arising from:

• Your use of VivaPic • The content you upload or generate • Your violation of these Terms • Your violation of third-party rights

11.1 By You

You may stop using VivaPic at any time by deleting the App and, if you have an account, requesting its deletion.

11.2 By Us

We may suspend or terminate your access if:

• You violate these Terms • You use the service fraudulently or abusively • Required by law • We decide to discontinue the service

11.3 Effects of Termination

Upon termination:

• Your right to use the App will cease • You will not have access to cloud-stored videos (if applicable) • Sections that by their nature should survive will continue in effect

12.1 Governing Law

These Terms are governed by the laws of Mexico, without reference to its conflict of law principles.

12.2 Dispute Resolution

Any dispute will be resolved through binding arbitration, except where the law requires otherwise.

12.3 Severability

If any provision is invalid, the remaining provisions will remain in full force.

12.4 Waiver

Failure to exercise any right does not constitute a waiver of that right.

12.5 Entire Agreement

These Terms constitute the entire agreement between you and 00LAR Solutions regarding the use of VivaPic.
